WTF Ohio?
Too all the Ohio residents reading this, what the fuck is wrong with your states legislators?

I know my LJ might as well be a RSS feed for Ed Brayton, but I'll risk potential criticism to draw attention to more government retardedness. Mr. Brayton reports that the Ohio state legislation just passed a law that would put people on the sex offender registry, even if they have never been charged with a crime!


An Ohio legislative panel yesterday rubber-stamped an unprecedented process that would allow sex offenders to be publicly identified and tracked even if they've never been charged with a crime.
No one in attendance voiced opposition to rules submitted by Attorney General Jim Petro's office to the Joint Committee on Agency Rule Review, consisting of members of the Ohio House and Senate.

A recently enacted law allows county prosecutors, the state attorney general, or, as a last resort, alleged victims to ask judges to civilly declare someone to be a sex offender even when there has been no criminal verdict or successful lawsuit.



Not a single legislator is willing to stand up against the growing "Child Predator" frenzy? Not one willing to say that some who has NEVER been charged in a court of law with a crime can be classified as such -- have their privacy and rights violated?!

WTF Ohio?!

Look, I am not pro-child molestation or anti-child well being or whatever stupid ass label over-politicized fuckheads would put on me, I think child molestation/rape is one of the most sick and dispicable crimes to ever happen in our society. I say its WORSE then murder, because you don't just end a life, you tear away someone's entire soul and condemn them to a life of misery and pain.

You know what I am, however? I am anti-stupid fucking laws that have the capability of condemning members of society without fair trials as brilliantly defined in our rights as citizens of this fuck FREE nation.

Citizen: What are you doing!
Police: I'm shoving this "I'm a really bad person" sign up your ass.
Citizen: What?! WHY?! I haven't done anything wrong!
Police: Well you LOOK like you are guilty of SOMETHING!

I agree with Mr. Brayton, every single one of those law makres should be thrown out of office and be place on the Fucking Idiot Registry!

I bet all these assholes didn't stand up against it for fear that an opposing pundit would brand them pro-child terrorism and they would never get elected again. Forget about the fact that this is an absolutely horrific law that has gret potential to violate a whole host of individual rights. This law isn't going to protect more children, its going to socially isolate and imprison innoncent people.

And this is why are system is so fucked. Political irrationality and frenzy has overcome any sort of logic or reason.

That's not even a big deal compared to other stuff they do...

How about being 1 of 2 states to not have consumer protection laws???

The other is North Dakota.

I think bill 185 recently passed, is a mild versian of what other states have.

And why is that important???

Ohio IS NUMBER ONE IN FORECLOSURES IN THE ENTIRE COUNTRY... and that's why!!

They are complete fucktards at the State.

See, I am like you. I think anyone proven to have abused or sexually assaulted a child deserves punishment to the full extent of the law.

I am, however, opposed to these 'sex offender' registries. At least for just those crimes.

I don't know about you, but I think that ALL violent crime against a person should be registered, not just sexual crimes. I think anyone proved to have murdered someone in the first degree should be registered also.

But, as usual, it's our fixation with sex that takes precedence, and the ever-present call of the 'socially concerened'...

"Won't someone PLEASE think of the children!"

I have mixed feelings about "registries." I think its nice to be able to keep tabs on people who could potentially cause more harm to society. The problem is, however, that even after they do there time, being on a registry essentially condemns them to a life sentence.

When it comes to child molesters, there is a very good chance that they will commit another crime without psychological and if need be medication therapy. I believe the recidivism is very high (70ish% I believe). Having them on a registry might be very much in the interest of the community.

However, registries will essentially guarantee that a person can never make anything better of themselves. They will never be able to live down their crime, or escape their stigma. Their information will be available to all, which also puts their lives in constant danger.

Some might say, "Good! They commited a crime and now they will have to apy for it through their whole lives! They forfeited their rights!" And though I don't necessarily disagree, I must also stress that in some cases, even if they are exceptionally rare, people do make mistakes and really want to move on and do something better after they have done their time. So even if the chance for reform is good, we have still commited them to a life sentence.

Consider for a moment a case here in Maine. A young man (21 I think) was placed on the sex offender list because his girlfriend was underage. There was no violent devastating crime commited, there was no indication that he was going to lead a life of deviance, his girlfriend was just too damn young for them to be involved.

That young man is now dead.

Why? Because his information was splashed all over and another gentleman, who had a psychotic break, grabbed a shotgun and decided to go down the sex offender list and clean up the state.

I realize that this is the case in only a slim percentage of the total "sex offenders." For the most part, child predators are disturbed, sick individuals that are very likely to commit another crime. But it is those rare instances that force me to take pause and consider again and again our legal system -- trying to figure out exactly what needs to be done to get help for ALL involved. Perhaps even the sick fuckers.

Have you ever scene The Woodsman? That is an excellent film that demonstrates this idea well.

Yeah, I didn't word my comment very well... the point I was trying to make is that I think that, if one type of violent crime against the individual is registered, then all types of violent crim against the individual should be too, or NONE at all.

I agree with you completely.

Again, it's sex-related so people freak out.

I do support the sex offender registries. For such things as rape, violent sexual crime, child molestation, and sexual assualt (the guys who walk up to random women on subways and flaunt their genitals in their face).

That said, I am less inclined for the person sun-bathing in their backyard for their first offense. That said, if they have no fences and there are children and neighbors near-by then they should have to put up a fence, etc. Or after repeat issues maybe constitute assault.

I also agree with Steph_Carlyle's post that I think other violent crimes should be listed. Murder, etc.

They can't, not logically anyway. People get worked up over the next big threat and pure emotion compels them to "do SOMETHING!" In that state of mind logic and thinking in the long term mean nothing.
